TERMS AND CONDITIONS – LIMITATION OF LIABILITY AGREEMENT

1. INTRODUCTION

This Terms and Conditions Agreement (the “Agreement”) governs your use of Currituck Connect’s platform and services (the “Services”). Currituck Connect (“the Company,” “we,” or “us”) facilitates introductions between consumers (“Customers”) and independent third-party service providers (“Service Providers”). By utilizing our Services, you agree to comply with and be bound by the terms of this Agreement.

 

 

2. NATURE OF SERVICES

Currituck Connect acts solely as a facilitator to connect Customers with Service Providers for the performance of specific tasks or services. Currituck Connect does not perform or oversee any of the services rendered by Service Providers and does not act as an agent, contractor, or employer of any Service Provider.

 

 

3. NON-LIABILITY DISCLAIMER

3.1 Independent Relationships:
Any contractual or business relationship, including agreements for service, payments, and dispute resolution, is strictly between the Customer and the Service Provider. Currituck Connect is not a party to any agreement entered into between a Customer and a Service Provider.

3.2 Exclusion of Warranties:
Currituck Connect provides its Services on an "as is" and "as available" basis without warranties of any kind, express or implied, including, but not limited to:

  • The quality, reliability, safety, timeliness, or completion of services provided by Service Providers;

  • The accuracy or reliability of information shared by Service Providers; or

  • The fitness of the Service Providers for any particular purpose.

3.3 No Liability for Damages:
To the fullest extent permitted under applicable law, Currituck Connect, its officers, directors, employees, affiliates, and agents shall not be liable for any damages, claims, losses, or expenses of any kind (whether direct, indirect, incidental, special, consequential, or punitive) arising from:
a. The performance, failure to perform, or improper performance of services by any Service Provider;
b. Any act, omission, or negligence of any Service Provider;
c. Customer’s reliance on any recommendation, introduction, or referral provided by Currituck Connect.

 

 

4. LIMITATION OF LIABILITY

Under no circumstances shall Currituck Connect, its affiliates, directors, employees, or agents be liable for damages exceeding the amount, if any, paid by the Customer to Currituck Connect for the Services provided. Customers expressly agree that Currituck Connect shall not be held responsible for:
a. Any personal injury, property damage, or financial losses caused by Service Providers;
b. Any claims arising from misrepresentation, fraud, or negligence on the part of Service Providers;
c. Delays, cancellations, or incomplete services.

 

 

5. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Currituck Connect, its officers, directors, employees, affiliates, agents, and successors from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
a. Your use of Currituck Connect’s Services;
b. Any agreement, dispute, or relationship between you and a Service Provider;
c. Your breach of this Agreement.

 

 

6. SERVICE PROVIDER VETTING

While Currituck Connect may perform limited screening of Service Providers (including reviews, background checks, or references), such vetting does not constitute a guarantee or endorsement of the Service Provider’s qualifications, skills, or reliability. Customers are solely responsible for conducting their own due diligence prior to engaging any Service Provider.

 

 

7. DISPUTE RESOLUTION

Any disputes or claims related to services rendered shall be resolved directly between the Customer and the Service Provider. Currituck Connect shall not be obligated to mediate, intervene, or assume liability for any disputes arising from services arranged through its platform.

 

 

8. ACCEPTANCE OF TERMS

By utilizing Currituck Connect’s Services, you acknowledge that you have read, understood, and agreed to this Agreement in its entirety. If you do not agree to these terms, you must refrain from using Currituck Connect’s Services.

 

 

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.

11. MODIFICATION OF TERMS

Currituck Connect reserves the right to update or modify this Agreement at any time. Continued use of our Services after such changes constitutes acceptance of the revised terms.
